Joint statement by Dr John Camacho and Dr Arthur Walsh
Groundbreaking ASIC Approved Public Examination of former Smiles Inclusive Directors, Officers and Advisors
Dr Camacho said: “ASIC has granted suburban dentists permission to cross examine Smiles Directors and Officers in the Federal Court in June. This includes Peter Evans, David Usasz, Peter Fuller, Emma Corcoran, Tony McCormack and Michelle Aquilina.”
Dr Walsh said: “This groundbreaking legal action follows the landmark Arrium decision in the High Court last year. Smiles shareholders and creditors, courtesy of the new ASIC regime, will finally have the opportunity to learn exactly what went on at Smiles Inclusive behind closed doors that led to the loss of $100m dollars.”
Dr Walsh added: “We are eternally grateful to Senator Deborah O’Neill for her support. This ASIC approved public examination of Smiles Directors and Officers in the Federal Court is only possible due to Senator O’Neill’s intervention.”
Dr Camacho added: “Better understanding the Brisbane systemic factors behind Smiles demise will be a key area of focus as we build the case for recovering $100m dollars from a range of parties via multiple avenues”.
Dr Camacho explained: “The examination is wide ranging including the Smiles IPO, failures in continuous disclosure, insolvent trading, diversion of Company funds, destruction of price sensitive documentation, veracity of loan documents, the 2019 audit and related rights issue, integrity of the whistle blower regime, legitimacy of the safe harbour protection and the role and independence of key advisors”.
Dr Walsh stressed: “Critically, we will finally learn direct from Link Market Services definitively what went on at the 2019 EGM. Who, what, when and how.”
Dr Walsh emphasised: “We intend to serve further summons covering bankers, stockbrokers, professional advisors and well-appointed former Smiles Officers. We will leave no stone unturned. We will provide process updates via our stakeholder website, www.smilesinc.com.au”
Dr Camacho concluded: “There are many more actors here and they too have been put on notice. We have put the ASX on notice. The ASX was well aware of serious issues from very early on.”
